User Agreement (Outline)｜GFP 農林水産物・食品輸出プロジェクト

Article 1: Application of Agreement: This user agreement is applied to all users who use this site, and users will use this site upon agreeing to this user agreement.; This office shall deem use of this site by a user as agreement to this user agreement.

Article 2: User Scope

Browsing of this site and use of search functions in this site (excluding use of features next the following section) can be executed by all users who agree to this user agreement.

Regardless of the preceding section, the following features can only be used by users who have offered information to this site.

（１）Browsing of detail pages;

（２）Publication of own company information, person in charge, commodity information, etc. on this site;

（３）Registering users of interest as favorites, My Page functions;

（４）Contacting other users, as well as browsing persons in charge or points of contact.

Article 3: Registration to This Site: Only registered GFP members can register as users of this site.; Users registered to this site manage their user ID and password on this site with the duty of care of a good manager under their own responsibility, and they cannot disclosure, transfer, or lend this to third parties.; In the event that an entered user ID and password coincides with one already registered, this office can deem this to be use by the corresponding user, and cause or related responsibility with said use will fall to the corresponding user.; Users can register on this site with their own information only, and cannot register with another person's information. Only one registration can be made by a single user, and duplicate registrations are not allowed. One's own information to register must be authentic, sufficient and the most recent, and users cannot enter falsehoods or intentionally leave important facts unentered. Furthermore, in the event of a change occurring in registered information, registered information must be updated promptly.; Users can delete their registration at any time with the method determined on this site, and in that event, information entered by the corresponding user will be erased from this site promptly after deregistration.; This office is not obligated to back up data saved by users onto the server managed by this office, and users will back up their data as necessary.

Article 4: Rules for Information Registration, Posting of Articles and Browsing

Users must not register or post information including the following content. In the event this is violated, this office may revise or erase some or all parts of the corresponding information, or suspend publication onto this site according to our judgement.

（１）Content deviating greatly from the purpose of this site;

（２）Content inconsistent with facts, false content;

（３）Duplicate registration content from the same single user;

（４）Posted content with intentionally identical content;

（５）Content judged by this office to be a matter related to individual problems or strife between users;

（６）Content violating the rights of other companies, such as copyrights, trademark rights, privacy rights, etc.;

（７）Content including personal information unrelated to the corresponding user;

（８）Content including inappropriate representation, such as name calling, discriminatory language, etc.;

（９）Content including indecent or obscene expressions;

（１０）Content perceived to coerce or threaten other users;

（１１）Content giving rise to rudeness, cruelty or crime;

（１２）Content touching on unjust inducement of profit for a third party, or defamation of trust/honor;

（１３）Content contrary to laws and ordinances or public orders and morals;

（１４）Any other content deemed by this office to obstruct operation of this site.

Users use any and all information offered by this office or other users on this site only within the scope of this site, will not disclose or leak corresponding info to third parties other than this office or corresponding users without prior consent from this office or other users providing the information, and bear responsibility after deregistration.

In the event of a user registering or posting information on this site (posting of latest articles, etc.), this office is allowed to reproduce, change, post, publicly transmit, or reprint, etc., corresponding posted content in order to carry out operation, use promotion, etc. of this site.

This office is allowed to monitor, analyze or investigate information provided or circulated by users (own company info, brand information, contact content between users, etc.), as well as use conditions, etc. when deemed necessary from a technical or operational standpoint.

Article 5: Prohibited User Activities

Users are not to engage in acts that corresponds to, or may correspond to prohibited items related to use of this site determined in the following numbers.

（１）Acts violating this user agreement;

（２）Acts using this service with another user's ID;

（３）Acts entering the ID and password of other users, or disclosing or offering IDs or passwords of other users, regardless of measures;

（４）Acts of false entry, or intentional omission of important facts onto this site;

（５）Acts falsifying or erasing information from this office or other users on this site;

（６）Acts using services offered by this office on this site for illegal purposes, or using them with ill intent;

（７）Acts violating or defaming intellectual property rights, rights to usage of one's likeness, privacy rights or other rights, assets, honor or reputation of this office, other users or third parties.

（８）Acts greatly deviating from the purpose of this site, such as political activities, election activities, or religious activities;

（９）Acts using this site or information on this site for development (including any sort of development work or test work, etc. with the aim of development) of technology or services using features analogous to or resembling those of this site's primary functions;

（１０）Acts transmitting or publicizing harmful computer programs such as virus, etc.;

（１１）Acts of secondary sale or distribution of this site's information regardless of payment or lack thereof, or acts using this site's information for commercial purposes, of acts acquiring, transferring or reproducing this site's information for any of these purposes;

（１２）Acts in violating of laws and ordinances, criminal acts, violent acts, and other acts in violating of public order and morals;

（１３）Acts while using this site deemed inappropriate by this office.

In the event of damages incurred to this office or third parties due to an action in the preceding section, all legal responsibility lies with the user, and damages will be compensated to this office or the third party.

Article 6: Copyrights, etc.: Users can only use this site under this user agreement and within any other scope determined by this office.; Users cannot reproduce, sell, publish, distribute, append changes to, or display this site or its contents without prior approval. Furthermore, users cannot violate, dilute, remove or add changes to attribution indicating all intellectual property rights on this site, or owners related to said rights.; Copyrights and any and all other rights related to all information offered on this site, excluding items registered by users based on their own authority, are all regarded as possessed or withheld by this office, other users or third parties providing corresponding information to this office, and are not items consenting to implementation or use of copyrights and all other rights for users, other than those explicitly determined in this user agreement by this office.; Intellectual property rights (indicates all rights including copyrights, trademark rights, author's personal rights, etc. Hereafter "IP rights") related to all content, text, images, data, information or other materials (hereafter "content") obtainable on or displayed in use of this site are the property of this office or the displayed owner, and are safeguarded by laws relate to IP rights.; Users may not use all information provided through this site outside of the scope determined by this office without prior consent of this office. However, a user can freely use information and content created or registered by the corresponding user themselves, such as their own company registration information, brand information, etc.; Users recognize that all content on this site or presented by this office has no confidentiality or withholding of ownership rights, is viewed throughout the world through this site without guidance of this office, and can be browsed, downloaded, printed, or used in other methods by all people.; Users recognize that, in the event of forfeiture of qualification as a user of this site, regardless of reason, use rights related to information offered through this site will automatically disappear.; In the event that this user agreement is violated and produces a dispute, users recognize that they are to resolve said dispute under personal responsibility and expense, and that no damages are to come to this office or third parties.

Article 7: Prohibition of Affiliation with Organized Crime: Users declare that they do not correspond to gangster organizations, gangsters, gangster organization associate members, businesses with gangster associations, fixers of stockholders' meetings, etc., advocates of social movements, etc., organized crime syndicates, etc. or other persons proportionate to these (hereafter "anti-social forces"), that five years have not passed since a time where they were no longer corresponding to anti-social forces, or that users or those substantially participating in their management do not have connections that would be criticized socially as anti-social forces, as well as give firm promise that they will not correspond to such in the future.

Article 8: Suspension of Use

In the event that a user is judged to correspond to one of the following numbers, this office can delete registration from this site without need for prior notice or notification to the user, and can take necessary steps such as suspension or restriction of use, prohibition from re-registration, etc.

（１）Cases corresponding to prohibited activities in Article 5;

（２）Cases in violation of declarations/firm promises in Article 7;

（３）Cases when there is seizure, provisional seizure or auction, or in cases of disposition for failure to pay taxes and public dues;

（４）Cases when there is a declaration of bankruptcy proceedings commencing, corporate reorganization proceedings commencing, or civil rehabilitation proceedings commencing, or in cases of significant unease occurred in regards to credit standing;

（５）Cases of measures such as withdrawal, suspension, etc., of operating permission by regulatory authorities;

（６）Cases of resolution such as dissolution, reduction of capital, transfer of all or an essential part of a business, or repeal/suspension of all or an essential part of a business;

（７）Other cases producing reason for making fulfillment of this user agreement difficult;

（８）Cases where use of this site is deemed inappropriate by this office.

Article 9: Temporary Suspension of This Site

This office may temporarily suspend use of this site without prior notice to users.

（１）In the event of maintenance of servers used for this service or system, change of specifications for this service or system, or repairing of system flaws, etc.;

（２）In the event that a natural disaster or another state of emergency occurs or may occur, or operation of this service becomes difficult or impossible due to revision or establishment of laws and ordinances;

（３）In any other event where temporarily suspension of this service's operation is deemed necessary by this office for unavoidable reasons;

This office does not take responsibility for damages to users or third parties occurring due to suspension of this service's operation determined in the preceding section.

Article 10: Disclaimer of This Office: This office does not offer any guarantee against flaws or bugs with regards to service content offered.; This office is not obligated to investigate with regards to identity verification of registered users, business conditions, etc.; This office does not offer any guarantee with regards to information published on this site offered by users, or the credibility, accuracy, integrity, usefulness or legality, etc. thereof.; This office does not offer any guarantee with regards to realization of results meeting user expectations for use of this site, and users recognize that they will not offer any objections about this to this office. Users are to engage in periodic backups, etc., for the event of damage or destruction of information registered to this site for any sort of reason, and this office does not accept any responsibility for damages due to user negligence of said engagement.; This office is not obligated toward any and all damages incurred by users due to or related to use of this site by users (includes registration and posting of information; same hereafter), or the inability to use this site. Furthermore, in the event that damages occur for users due to use of this site by other users, this office does not accept any responsibility.; In the event of trouble occurring between third parties (including other users) due to or related to use of this site by users, the corresponding user is to attempt to resolve said trouble under their own responsibility, and this office this office does not accept any responsibility related to this.; This office does not accept any responsibility for damages occurring to users from suspension of use based on Article 8, temporary suspension of this site based on Article 9, delay or loss of information due to cancellation of registration to this site based on Article 11, misdelivery of information by users, as well as falsification or leakage of information by third parties, etc.; Users are to compensate damages incurred by this office (including legal fees paid by this office) from use of this site by the corresponding users.

Article 11: Changes to This Site: This office can change this site's content (including functions and services of this site), or abolish this site without prior notice to users.; This office can transfer some or all services on this site, some or all rights based on this user agreement, or their position under this user agreement, to a third party at the discretion of this office.

Article 12: Changes to This Agreement: This office may make changes to this user agreement or tips applied to users of on this site (including additions or deletions; same hereafter) without prior notice to users.; After changes to this user agreement or tips are posted on this site, user access and use of this site shall be deemed as agreement.; In the event that this office changes this user agreement and changes conditions of use, the changed user agreement and conditions of use will be applied even to use already consented. Even if disadvantage occurs to users due to revision of this use agreement, this office does not accept any responsibility.

Article 13: Handling of Personal Information: Handling of personal information by this office on this website is done under the Privacy Policy determined separately, and users agree to this policy. Furthermore, users who registered information to this site, at the time of registration, agree in advance for personal information of corresponding users to be offered to other users who registered information on this site within the scope of Purpose of Use determined by the Privacy Policy.

Article 14: Separability: Any articles or parts thereof of this user agreement do not affect the validity of other articles or parts thereof of this user agreement, even in the event that they are deemed invalid or unenforceable due to applied laws and ordinances, etc.

Article 15: Governing Laws and Jurisdiction: The governing law of this user agreement is Japanese law, and any and all disputes occurring from this user agreement or Japanese law will take place at the Tokyo District Court as an exclusive agreement jurisdictional court for the first hearing.
